4. Website information and medical disclaimer

The information provided on our website is intended for general educational and informational purposes. It may include information about aesthetic treatments, skin health, skincare products, treatment options and general clinical considerations.

Although we aim to ensure that information is accurate and up to date, website content should not be regarded as individualised medical advice, a diagnosis or a recommendation that a particular treatment is suitable for you.

Individual suitability depends on factors such as medical history, current medication, skin condition, contraindications and clinical assessment.

Before undergoing a treatment, you should receive an appropriate consultation with a suitably qualified practitioner. Treatment recommendations, risks, expected outcomes and alternatives should be discussed with you before you make an informed decision.

You should not rely on website information as a substitute for professional medical assessment or treatment.

If you have an urgent medical concern, seek appropriate medical assistance. In an emergency, call 999. For urgent medical advice in England, you can contact NHS 111.

5. Treatments and results

Information about treatments, products and services is provided to help visitors understand the options that may be available at Emerge Aesthetics.

Treatment availability, suitability, pricing and outcomes may vary according to individual circumstances.

We do not guarantee that a particular aesthetic outcome will be achieved. Results may vary between individuals and may be affected by factors including anatomy, skin condition, lifestyle, medical history, treatment choice and aftercare.

Photographs and other visual examples on our website or social media may illustrate treatments or results. They should not be interpreted as a guarantee that you will achieve the same outcome.

All treatments are subject to appropriate assessment, clinical suitability, informed consent and any applicable professional or legal requirements.

We reserve the right to decline or defer a treatment where it is not clinically appropriate, subject to applicable law and our professional obligations.

6. Appointments and bookings

Our website may direct visitors to an external booking platform or provide an enquiry form to request further information about appointments.

Submitting an enquiry does not automatically constitute a confirmed appointment or create a contract for treatment.

Where appointments are booked through a third-party platform, its booking procedures and terms may also apply. Please review the relevant conditions before completing your booking.

Appointment availability, deposits, cancellation arrangements, rescheduling conditions and refunds will be communicated through the relevant booking process or separate booking terms.

Any cancellation fees or other charges will be subject to the applicable booking agreement and consumer protection law.

Nothing in these Terms and Conditions removes any statutory rights you may have in relation to a booking or service.

7. Prices, promotions and offers

Prices, promotional offers and service descriptions displayed on our website are provided for information purposes and may be updated from time to time.

Where prices are published, we aim to ensure that they are clear and accurate. Any applicable charges and material conditions will be communicated before you commit to a purchase or booking.

Promotional offers may be subject to specific eligibility criteria, availability, dates or other conditions. These conditions will be provided with the relevant promotion.

We reserve the right to correct genuine errors or withdraw or amend future promotions, subject to applicable law and any commitments already made to customers.

If a price or promotional detail appears incorrect, please contact us for clarification before proceeding with a booking.

8. Skincare products and external retailers

Our website may provide information about skincare products and links to external retailers, including retailers offering professional or medical-grade skincare products.

Unless expressly stated otherwise, Emerge Aesthetics does not sell or fulfil orders for products purchased directly through external retailer websites.

Purchases made through external retailers are subject to the relevant retailer's terms, payment arrangements, delivery conditions, returns policies and privacy practices.

We are not responsible for the operation of external retailer websites or for products, services or transactions supplied directly by third parties. This does not exclude any liability that we may have where applicable law provides otherwise.

Product information on our website is not a substitute for individual skincare advice. If you have a skin condition, allergies or concerns about the suitability of a product, seek appropriate professional advice before use.

9. Training courses and educational content

Our website may contain information about training courses, educational resources, professional development and clinical support.

Course descriptions are intended to explain the content and objectives of the relevant educational offering. They do not, by themselves, guarantee a particular qualification, professional registration, scope of practice or entitlement to perform a treatment.

Entry requirements, course fees, payment arrangements, cancellation conditions, attendance requirements, assessment procedures and certification arrangements may be governed by separate course-specific terms.

Where training is provided, participants remain responsible for ensuring that their professional qualifications, registration, insurance, competence and scope of practice permit them to undertake any clinical activities concerned.

Clinical training materials and educational content should be used in conjunction with appropriate professional guidance, current evidence, applicable legislation and relevant clinical policies.

10. Intellectual property

Unless otherwise stated, the content on our website, including text, photographs, graphics, logos, branding, design elements and original educational materials, belongs to Emerge Aesthetics or is used under an appropriate licence.

You may view and access website content for your personal, non-commercial use.

You must not reproduce, distribute, modify, republish, sell or commercially exploit our content without our prior written permission, except where permitted by law.

Nothing in these terms transfers ownership of our intellectual property to you.

If you believe that material on our website infringes your intellectual property rights, please contact us with details of the material concerned and the basis of your concern.

11. External links and third-party services

Our website may contain links to third-party websites, including booking platforms, skincare retailers and social media services.

These links are provided for convenience and information. We do not control all aspects of these external websites and cannot guarantee the accuracy, availability, security or accessibility of their content.

A link to a third-party website does not necessarily indicate endorsement of that provider or its products and services.

Your use of third-party websites is subject to their own terms, privacy policies and other applicable conditions.

12. Website availability and accuracy

We aim to keep our website available, functional and accurate. However, we cannot guarantee uninterrupted access or that the website will always be free from errors, technical faults or temporary interruptions.

We may update, amend, suspend or remove website content or features where reasonably necessary, including for maintenance, security, operational or legal reasons.

We will take reasonable steps to maintain the website, but we do not guarantee that every feature will be compatible with every device, browser or assistive technology.

Nothing in this section limits any rights or remedies available to you under applicable law.

13. Liability

We will exercise reasonable care in providing information through our website. However, website content is provided for general information and should not be relied upon as a substitute for individual clinical assessment or professional advice.

To the extent permitted by law, we are not responsible for losses arising solely from reliance on inaccurate or incomplete general website information where it was reasonable for you to verify that information before acting on it.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful. In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these terms affects your statutory consumer rights, including rights relating to services provided with reasonable care and skill.

14. Privacy and cookies

Your use of our website is also subject to our Privacy Policy and Cookie Policy.

Our Privacy Policy explains how we handle personal information, including information submitted through website enquiry forms.

Our Cookie Policy explains how cookies and similar technologies may be used on our website and how you can manage your preferences.

Please review these policies to understand how your information is handled.

15. Accessibility

We aim to make our website accessible to as many people as possible.

If you experience difficulty accessing information or using a feature of our website, please contact us so that we can consider the issue and, where reasonably practicable, offer an appropriate alternative.

Further information is available in our Accessibility Statement.

16. Changes to these Terms and Conditions

We may revise these Terms and Conditions from time to time to reflect changes to our website, business operations, services or applicable legal requirements.

The latest version will be published on this page with the date of the most recent update.

Changes will apply to future use of the website from the date they are published, subject to any applicable legal requirements and existing contractual commitments.

Where a separate agreement governs a booking, treatment or course, changes to these website terms will not automatically override that agreement.

17. Complaints and contact

If you have a question, concern or complaint about our website or the information provided on it, please contact us.

18. Governing law

These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protection rules that apply to you.

Any disputes will be dealt with by the courts with appropriate jurisdiction, without affecting any rights you may have under applicable consumer law.

19. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

20. Entire agreement

These Terms and Conditions govern your general use of the Emerge Aesthetics website.

They do not replace any separate agreement, treatment consent documentation, booking conditions, course terms or other contractual arrangements that may apply to a particular service.

PART A — ONLINE COURSE PURCHASES

1. Course information

Emerge Aesthetics provides educational resources and training relating to medical aesthetics and associated clinical skills. Courses may include, but are not limited to:

  • Anatomy and physiology.

  • Microneedling.

  • Chemical peels.

  • Intramuscular vitamins.

  • Skin analysis and skincare.

  • Regenerative treatments.

  • Other aesthetic treatments, clinical skills and professional development subjects.

The specific content, format, learning outcomes, duration and access arrangements, will be described on the relevant course sales page.

Certificates will be provided following successful completion of a course, determained by the course assessor. Certificates will be provided within 14 days of course completion, via email or WhatsApp.

Please read the course description carefully before purchasing.

2. Eligibility and learner responsibility

You are responsible for ensuring that you meet any stated entry requirements before purchasing a course.

Some courses may be intended for registered healthcare professionals, qualified aesthetic practitioners or learners with relevant prior training. Where restrictions apply, these will be stated in the relevant course description.

You are responsible for ensuring that any practical or clinical skills you undertake are appropriate to your qualifications, competence, professional registration, insurance and scope of practice.

Completing an online course does not automatically authorise you to perform a treatment, prescribe medicines or undertake procedures outside your professional scope.

Where a course requires practical experience, supervised training or further qualifications, these requirements remain applicable even after completing the online material.

3. Purchasing a course

Course purchases must be completed through the designated checkout or payment process.

Before placing an order, you should review the course description, price, content, access period and any applicable additional requirements.

Your order constitutes an offer to purchase the course. A contract will be formed when we accept your order and confirm the purchase.

We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, an obvious pricing error or failure to meet essential course eligibility requirements. Where payment has been taken for an order we cannot fulfil, an appropriate refund will be provided.

You must provide accurate contact information so that we can issue purchase confirmations and provide course access.

4. Course prices and payment

All course prices will be displayed on the relevant course page or checkout before you complete your purchase.

The applicable price and any additional charges will be disclosed before payment is taken.

Payment must be completed using the payment methods made available at checkout.

Where a payment plan or instalment arrangement is offered, the applicable payment schedule and conditions will be disclosed before you commit to the arrangement.

You must not attempt to circumvent the payment process or obtain paid course content without authorisation.

5. Course access and delivery

Course access arrangements will be explained on the relevant course page or in your purchase confirmation.

Depending on the course, access may be provided through an online learning platform, downloadable materials, recorded lessons or another specified delivery method.

Where applicable, you will receive instructions for accessing your purchased course using the email address supplied at checkout.

You are responsible for maintaining access to your email account and using compatible devices, software and internet connectivity.

We will take reasonable steps to provide the course as described and to address technical issues within our control.

If you experience difficulty accessing purchased content, please contact us for assistance.

We will not unreasonably withhold access to a course you have purchased and paid for in accordance with these terms.

6. Course access periods

The access period for each course will be stated on the relevant course page or in the purchase confirmation.

Where lifetime access is advertised, this means access for the lifetime of the relevant course offering or platform arrangement, subject to applicable law and any clearly disclosed conditions. It does not mean that access is guaranteed indefinitely regardless of circumstances.

We will not remove access arbitrarily or use this clause to avoid our contractual obligations.

If a course is withdrawn, a platform is discontinued or a significant change affects your access, we will consider reasonable alternatives and any remedies required by law.

7. Digital content and cancellation rights

We want you to understand your cancellation rights before purchasing a course.

For eligible online and distance purchases, consumers generally have a 14-day cancellation period. The precise rules depend on whether the contract is for digital content, a live training service or a combination of both.

Pre-recorded courses and digital downloads

Where a course consists of digital content supplied online, you may lose your statutory right to cancel during the 14-day cancellation period if:

  • You expressly consent to the supply of the digital content beginning before the end of that period.

  • You acknowledge that you will lose your right to cancel once supply begins.

  • We obtain that consent and acknowledgement before providing the content and meet the applicable confirmation requirements.

Where these requirements have not been satisfied, your statutory cancellation rights may remain available.

Live online training and other services

Where a course involves live teaching, mentoring or another service, separate cancellation rules may apply. If you request that a service begins during the cancellation period, additional legal requirements may apply if you later cancel.

The cancellation arrangements for a particular course will be explained before purchase where applicable.

How to cancel

To exercise a cancellation right, email emerge.aesthetics@outlook.com with your name, the course purchased and your order reference, together with a clear statement that you wish to cancel.

Nothing in these terms removes any statutory cancellation rights or other legal remedies available to you.

8. Refunds

Refund requests will be assessed in accordance with the applicable course terms and consumer law.

Where you have a statutory right to a refund, we will honour that right.

If you have lost your statutory cancellation right for digital content in accordance with the requirements described above, a change of mind alone will not necessarily entitle you to a refund.

However, if course content is not supplied as agreed, is materially different from its description, or fails to meet applicable statutory requirements, you may be entitled to a remedy, which may include repair, replacement, a price reduction or a refund, depending on the circumstances and applicable law.

Please contact us if you experience a problem with a purchased course so that we can investigate and discuss an appropriate resolution.

9. Changes to course content

We may update course materials from time to time to reflect changes in clinical evidence, guidance, legislation or educational practice.

Minor updates that improve accuracy, presentation or usability may be made without materially changing the course.

We will take reasonable steps to ensure that significant changes do not materially undermine the course description or the content you purchased.

If a substantial change or cancellation prevents us from delivering the course as agreed, we will consider appropriate alternatives or remedies in accordance with our contractual obligations and applicable law.

10. Certificates and completion

Where a course includes a certificate of completion, the relevant course page will explain the requirements for receiving it.

A certificate of completion confirms the status described by the course provider. Unless expressly stated otherwise, it does not constitute a regulated qualification, professional registration, licence to practise or independent prescribing qualification.

You are responsible for checking whether a course meets the requirements of your professional regulator, insurer, employer or relevant awarding body before purchasing it.

We do not guarantee that an external organisation will recognise a course unless this has been expressly confirmed.

11. Educational disclaimer and clinical responsibility

Our courses are designed to provide educational information and support professional development.

Course materials are not a substitute for individual clinical supervision, professional judgement, current clinical guidelines, product-specific instructions or appropriate practical training.

Clinical practice must be undertaken in accordance with applicable legislation, professional standards, patient safety requirements and the practitioner's scope of practice.

You remain responsible for your own clinical decisions and for ensuring that you are appropriately trained, competent and insured before undertaking any clinical procedure.

Where course content relates to medicines, injectable treatments or other regulated activities, you must comply with the relevant prescribing, supply, administration and professional requirements.

12. Intellectual property and permitted use

All course materials supplied by Emerge Aesthetics, including videos, presentations, documents, diagrams, assessments, written content and downloadable resources, remain the intellectual property of Emerge Aesthetics or the relevant rights holder unless otherwise stated.

Your purchase grants you a personal, non-transferable licence to access and use the course materials for your own learning.

You must not, without prior written permission:

  • Share your login details or allow another person to access your purchased course.

  • Copy, reproduce, distribute, resell or commercially exploit course materials.

  • Upload course materials to public websites, file-sharing platforms or unauthorised learning platforms.

  • Record, reproduce or redistribute lessons or teaching sessions where prohibited.

  • Present our course materials as your own work or training programme.

Nothing in this section restricts rights that cannot lawfully be excluded.

13. Misuse of course access

We may investigate suspected unauthorised sharing, fraudulent access or infringement of intellectual property rights.

Where appropriate, we may suspend access while investigating a genuine security or misuse concern. Any suspension or termination will be proportionate and consistent with our contractual obligations and applicable law.

Where a breach is established, we may take reasonable steps to protect our materials and platform, including restricting unauthorised access.

Any decision to terminate a learner's access will take account of the circumstances and any applicable statutory rights. This section does not permit us to retain payment or deny a remedy where the law requires otherwise.

14. Technical requirements

You are responsible for having a suitable device, internet connection and compatible software to access the course.

We cannot guarantee that every course will operate on every device or browser. However, we will take reasonable steps to resolve technical problems within our control.

If a technical issue prevents you from accessing a purchased course, please contact us with details of the problem so that we can investigate.

15. Liability and statutory rights

We will exercise reasonable care and skill in delivering our courses and will comply with applicable consumer protection legislation.

Nothing in these terms excludes or limits liability where such exclusion or limitation would be unlawful.

In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these terms removes your statutory rights relating to digital content or services.

16. Complaints

If you have a concern about your purchase, course access, educational materials or the service provided, please contact us at emerge.aesthetics@outlook.com.

Please include your name, order reference and a description of the issue.

We will review your complaint and aim to respond within a reasonable timeframe.

PART B — COURSE ENQUIRIES BY EMAIL

17. Making a course enquiry

If you would like further information about a course, upcoming training dates, course availability, entry requirements, pricing or a bespoke training opportunity, you may contact Emerge Aesthetics by email or through our website enquiry form.

Please provide sufficient information for us to understand your enquiry. You may include the course you are interested in, your relevant professional background and any questions you would like us to address.

Please do not send unnecessary sensitive personal information or confidential patient information in a course enquiry.

18. No purchase obligation

Sending an email or submitting a course enquiry does not constitute a purchase, reserve a place on a course or create an obligation to pay.

We will provide further information where reasonably practicable.

A course booking or purchase will only be confirmed through the relevant booking or checkout process, or through a separate written agreement where applicable.

If a course requires an application, eligibility check, deposit or other preliminary step, we will explain the relevant requirements.

19. Accuracy of enquiry information

You are responsible for ensuring that the information you provide is accurate and not misleading.

Where a course has professional entry requirements, we may ask you to provide relevant information to establish whether the course is suitable for you.

Submitting an enquiry does not guarantee acceptance onto a course, availability of a place or eligibility for any particular training programme.

20. Responses to enquiries

We aim to respond to course enquiries as soon as reasonably practicable. Response times may vary depending on demand, staff availability and the nature of your enquiry.

Any information supplied in response to an enquiry is provided for guidance and does not constitute a confirmed booking or binding offer unless expressly stated.

Course prices, dates, availability and requirements may change before a purchase is completed. The applicable details will be confirmed before you commit to a purchase.

21. Enquiry emails and marketing communications

We may use the contact details you provide to respond to your enquiry and communicate with you about the specific course or information you have requested.

Submitting a course enquiry does not automatically subscribe you to marketing emails.

If you would like to receive promotional emails about future courses, offers, training dates or other services from Emerge Aesthetics, we will seek your consent where required by law.

You can withdraw your marketing consent at any time by using the unsubscribe link in a marketing email or contacting us directly.

We will handle your personal information in accordance with our Privacy Policy and applicable data protection and electronic marketing laws.

22. Confidentiality and personal information

We will handle information submitted through course enquiries in accordance with our Privacy Policy.

Please avoid including payment card details, passwords, confidential patient information or other unnecessary sensitive information in emails.

We will use enquiry information for the purpose of responding to your request, administering any subsequent booking and meeting applicable legal obligations.

Further details about how we collect, use, store and protect personal information are available in our Privacy Policy.
